Section 21
Do not shirk your responsibility
(1) An officer who is required to perform work according to this Act or the prevailing law shall perform the work assigned to him or performed by him according to this Act or the prevailing law within the prescribed conditions and within the prescribed period.
(2) Officials who have to perform work according to sub-section (1) shall not shirk their responsibility or make someone else do the work they are supposed to do, except in the case of section 22.
(3) Officials who employ others in violation of sub-section (2) or shirk their responsibilities in any other way or do not perform their work within the prescribed period or do not achieve achievements according to the performance indicators with the intention of shirking their responsibilities in any other way, if the Chief Secretary is the Government of Nepal (Council of Ministers), if the Secretary is the concerned Minister, the official under the Ministry If there is a departmental head, the concerned secretary and other officials under the department, the concerned departmental head can give a warning.
(4) Even after warning in accordance with sub-section (3), if there is no improvement in the conduct and work actions of such official, departmental action shall be taken against such official based on lack of efficiency in accordance with prevailing law.
